Bryan Kohberger Update: Why Did the Court Deny Kohberger’s Appeal To Dismiss Jury Indictment?

On December 30, 2022, authorities charged Bryan Kohberger for brutally killing four students near the University of Idaho. The tragic incident occurred in November 2022 and garnered much media attention. He has been in custody since December 2022 and is awaiting trial. However, his attorneys filed a motion to dismiss the indictment against Kohberger. But things didn’t go their way because the court denied their request to dismiss the indictment against him, giving a massive setback to the accused and his team of lawyers.

According to CBS2 Idaho News, the judge noted that although the case involves a series of charges, the issues raised by the defense team in the motions to dismiss the indictment are “not exceptional.” Citing the court, the media outlet also mentioned that the issues raised by Kohberger’s attorneys do not constitute “substantial legal issues of great public interest or legal questions of first impression.”

This is not the first time an appeal similar to this has been denied in the case. The defense team filed a similar motion after they alleged that the jury received incorrect information. As a result, they labeled the jury “biased.” The team said a lot of other things in their filed appeal, but the court denied both appeals. As of now, the court hasn’t yet announced a trial date in the Bryan Kohberger murder case. However, it’s important to note that Kohberger’s team has filed a motion for a change of venue, which will be heard in court.

On November 13, 2022, four students of the University of Idaho were found dead in their off-campus home in Moscow, Idaho. According to the autopsy, the victims were identified as Madison Mogen, Xana Kernodle, Kaylee Goncalves, and Ethan Chapin. Citing the authorities, CBS News reported that the killer used an “edged weapon such as a knife” to murder the victims. As the investigations progressed, police announced that they were looking for a person in a white Hyundai Elantra seen near the crime scene. After the police collected much evidence, they arrested Bryan Kohberger in the murder case.

In May 2023, the accused faced charges of burglary and four counts of first-degree murder. The court asked him if he pleaded guilty to the charges. CBS News reported that Kohberger didn’t reply to the question, and as a result, the court entered a “not guilty” plea on Kohberger’s behalf. However, things went downhill for Kohberger after the DNA report.

Citing the court documents, the publication reported the authorities discovered “a near-exact match to the DNA found on a knife sheath at the scene.” At the time, the court announced that the trial would begin in October 2023. However, Bryan Kohberger waived his right to a speedy trial. As a result, the court postponed the trial.

The prosecution team called the postponement as a “smart move.” However, the prosecutors made it clear that they would pursue the “death penalty” for Bryan Kohberger. The family members of the victims were also anticipating the trial and thanked the prosecutors for going for the death penalty. Citing the statement, The New York Times noted, “There is no one more deserving than the defendant in this case.”

In a recent interview, Kohberger’s attorney said he is calm and believes that he is going to be free. According to Daily Mail, Bryan Kohberger is currently staying at the Latah County Jail. As mentioned above, the court has not set a trial date for the case.
